TERMS AND CONDITIONS OF USE
These Terms and Conditions of Use (hereinafter referred to as "Terms of Usage") govern your use of the content and services (hereinafter referred to as "SERVICES") provided through the Oxtalk mobile application (hereinafter referred to as “We,” “Oxtalk,” “us,” “our,” “Oxtalk App,” or “Website”).
UPDATION
The Oxtalk App may update, amend, or modify these Terms of Usage from time to time. It is the User’s responsibility to check these Terms periodically to stay in compliance with these terms.
USER CONSENT
By accessing and using the Oxtalk App, you ("Member," "You," "Your," "User," "he," "his," "they," etc.) indicate that you understand and unconditionally consent to these Terms of Usage. If you do not agree with the Terms of Usage, please do not click on the “I AGREE” button. It is advised that you carefully read these Terms before using or registering on the App or accessing any materials, information, or services. Your continued use of the App signifies your acceptance of these Terms and your agreement to be legally bound by them.
GENERAL DESCRIPTION
The Oxtalk App is an internet-based portal available on mobile devices and other electronic mediums. Users can view content posted by other users, interact with other users via video calls, chat, etc. (hereinafter referred to as "Content"). Users are required to register as a member on the platform. By registering, a Member agrees to:
- Provide current, complete, and accurate information as prompted by the App.
- Maintain and update the provided information to ensure its accuracy and completeness.
REGISTRATION AND ELIGIBILITY
To use the services, users must be capable of forming legally binding contracts under applicable law. A minor (under the age of eighteen) is not permitted to use the services unless they have a legal guardian in accordance with the laws. The Oxtalk App will not be held responsible for any misuse of the services by minors.
For registration, users must provide accurate and complete information. The user agrees to maintain updated information and acknowledges that inaccurate, incomplete, or false details may lead to account suspension or termination.
Creating multiple accounts using different mobile is prohibited. The right to use the Oxtalk App is personal and non-transferable. Users are responsible for maintaining the confidentiality of their passwords and account details and are fully responsible for all activities under their account.
APP CONTENT
The content posted on the Oxtalk App and any content accessed via external hyperlinks is the private property of the App. The App reserves the right to modify, suspend, or discontinue any part of its service.
The App strictly prohibits users from posting content that:
- Is offensive, discriminatory, obscene, pornographic, or violent.
- Encourages illegal activities or could be harmful to others.
- Is defamatory, libelous, or violates any third-party intellectual property or privacy rights.
- Contains viruses or malware designed to harm or disrupt the platform.
USER ACCOUNT ACCESS
Oxtalk reserves the right to access user accounts and their information to ensure the quality of services and address customer needs. Users consent to such access and understand that the App may investigate any misuse or reported abuse.
PRIVACY POLICY
Users consent to the terms of the Privacy Policy of the Oxtalk App, which governs the collection, storage, and handling of personal data. Users agree to periodically review the Privacy Policy to stay informed about how their personal information is used.
BREACH AND TERMINATION
The Oxtalk App reserves the right to modify, discontinue, or alter services at any time. Violation of any terms in these Terms of Usage may result in the immediate cancellation of your account and access to the platform.
Oxtalk has the right to terminate an account or restrict access without notice if:
- The registration information is inaccurate or unverifiable.
- User actions may cause legal liability for the platform, other users, or service providers.
- The user has violated the terms or privacy policy.
Monitoring and Violation Policy

Video Call Monitoring: For safety and quality assurance purposes, we reserve the right to monitor video calls conducted on our platform. This may include random checks or investigation-based monitoring in case of reported or suspected violations.

Violation of Platform Rules: If a host is found violating any of our community guidelines or engaging in prohibited activities during a video call (including but not limited to nudity, vulgar language, solicitation, harassment, or illegal conduct), we reserve the right to take appropriate actions.

Account Suspension or Termination: Upon detection of any violation, we hold full authority to temporarily suspend or permanently block the host’s account without any prior notice.

Withholding or Deducting Payment: In the event of a violation, the host’s pending or completed earnings may be partially or entirely withheld. Additionally, coins or rewards earned during the affected session(s) may be deducted from the host’s account.

No Refund Policy for Users in Case of Host Violation: If a user reports a violation during a video call, and it is verified, no refund will be provided to the host for that session. The platform may refund coins to the user at its sole discretion.

Zero Tolerance for Repeat Offenders: Hosts who are found repeatedly violating platform rules will be permanently banned and blacklisted from rejoining under any identity.

Consent to Monitoring: By using our platform, hosts agree to and accept that their video calls may be monitored for compliance, and that any actions taken as a result of violations are final and non-disputable.
Profile Optimization for Platform Enhancement
To improve user experience and promote platform growth, we reserve the right to make limited adjustments to user profiles, such as display names, profile pictures, or visibility settings. These changes will always respect user integrity and platform guidelines, and are intended to enhance discoverability, engagement, or overall community quality. Users will be notified of any significant changes made to their profile.Oxtalk WALLET
The Oxtalk App provides a wallet for users to store coins for transactions within the platform. coin stored in the wallet can be used for:
- Making video calls with streamers.
- Sending gifts to streamers.
- Purchasing products or services offered by Oxtalk .
USER OBLIGATION
Users (including streamers) must not violate the privacy policy, terms, or any other policies on the platform. The following actions are prohibited:
- Posting false, misleading, defamatory, harmful, or discriminatory content.
- Uploading content that infringes intellectual property or other rights.
- Sending unsolicited emails, spam, or engaging in activities that disrupt the platform’s operation.
- Engaging in unauthorized access to other users' accounts or platform systems.
- Users must report any misuse or abuse of the platform immediately. Violations may result in termination without refund.
DISCLAIMER / LIMITATION OF LIABILITY
The Oxtalk App and its services are provided "as is" without warranties of any kind. The platform does not guarantee that services will meet user requirements or be uninterrupted, secure, or error-free. Users are solely responsible for the risks associated with using the platform, and the App is not liable for any losses, damages, or data loss.
IN-APP PURCHASE AND PAYMENT TERMS
Types of In-App Purchases:
- Users can purchase coins using real money through Google Play’s in-app purchase system or UPI intent-based payment.
- Coins can be used for various in-app activities and are non-transferable to other users or accounts.
Payment Processing:
- Payments are processed securely via Google Play Billing or UPI intent payment.
- Users must have a valid payment method linked to their Google account or UPI-enabled bank account.
- Prices are displayed in the user’s local currency, subject to exchange rates and platform fees.
Coin Purchases & Usage:
- Purchased coins are credited to the user’s account instantly upon successful payment confirmation.
- Coins cannot be exchanged for real money, transferred, or refunded unless required by law.
- The app reserves the right to modify the value or pricing of coins at any time.
Refund Policy:
- Google Play in-app purchases: Refund requests must be submitted through Google Play Store as per their refund policy.
- UPI payments: Once a transaction is completed, it cannot be refunded unless a system error occurred (e.g., payment deducted but coins not credited).
- Users should report failed transactions within 48 hours via the customer provided in the app.
Auto-Renewal & Subscription:
- If any subscription-based coin packages are introduced, they will be auto-renewed unless canceled in Google Play settings before the next billing cycle.
- Subscription prices are subject to change, and users will be notified in advance.
Pricing, Taxes & Changes:
- The app reserves the right to change coin prices or offer promotional discounts at any time.
- Any applicable taxes or service fees will be included in the final payment amount.
Unauthorized Transactions & Security:
- Users are responsible for securing their accounts and payment details.
- The app is not liable for unauthorized purchases made from a user’s account.
- If unauthorized transactions occur, users should immediately report them to Google Play Support or their UPI service provider.
Termination & Loss of Coins:
- If an account is banned or terminated due to violating app policies, any remaining coins may be forfeited without refund.
- In case of technical errors or account issues, users should contact customer support for resolution.
Updates to Payment Terms:
- The app reserves the right to update these terms at any time, with notifications sent via in-app messages or email.
- Continued use of the app after changes implies acceptance of the updated terms.
INDEMNIFICATION
Users agree to indemnify and hold Oxtalk and its affiliates harmless from any claims or damages arising from the misuse of the platform or violation of these Terms of Usage.
PROPRIETARY RIGHTS TO CONTENT
Content posted on the Oxtalk App is protected by intellectual property laws. Users may not copy, distribute, or create derivative works from the content without explicit permission from the platform.
NOTICES
All notices related to these Terms of Usage shall be provided via email.
GOVERNING LAW AND JURISDICTION
Any disputes arising from these Terms shall be resolved through arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996. The courts of New Delhi shall have exclusive jurisdiction.
